Why Disclosure of Agency is Important to Know

Under Wisconsin law:

No broker may provide brokerage services unless the broker has provided a written agency disclosure.

(if you didn’t get a disclosure of agency form ask for one)

Line 55 of the disclosure of agency will tell you the name of the agency, the associate, and who that agency is representing. Most of the time it will be the seller. The selling agent is obligated to get the best price, under the best condition for the seller.

Question: Why would you want to work with an agency that represents the seller ?

Answer: You Don't.

Question: What is the procedure to receive buyer representation?

Answer:  The only way that the buyer can be represented, is to have a buyer agency agreement. This will provide you with an agent, that represents the buyer’s best interest. Don't be fooled, without a buyer agency agreement, that agency/agent cannot represent the buyer and always represents the seller,  If your involved in a law suite, you would not hire the same attorney, as the person suing you?   

Question: What is a listing ?

Answer: A listing is a contract that gives an agency, the right to sell a property.  Buyers Choice Realty never contracts to sell property, therefore we can never represent the seller.

Question: What does Buyers Choice Realty LLC do?

Answer: Buyers Choice Represent Buyers Exclusively.

Wisconsin Statutes 452.135 Says

(2) No broker may provide brokerage services to a party to a transaction unless the broker has provided to the party a written agency disclosure form containing all of the following:

( a ) A statement of which party is the broker’s client or, if the broker is providing brokerage services to more than one client under 452.137 a statement of which parties are the broker’s client.

( b ) A statement of the broker’s duties to his or her client under 452.133 (2).

( c ) A statement of the broker’s duties to a party under 452.133 (1)

( d ) A statement regarding confidentiality.
